Regeringen har nu släppt propositionen om en harmoniserad patenträtt. Jag blir alltid skeptisk när man släpper en brutaltung proposition och säger att den “inte innebär några förändringar i sak”. (Varför har man då lagt ner en massa arbete på den?)

Extra ryggar jag tillbaka när jag ser att man specifikt förändrar portalparagrafen som behandlar patenterbarheten kring affärsmetoder och datorprogram. Man är inne och rör vid de paragraferna, men jag kan inte tolka det på något annat sätt än att affärsmetoder och datorprogram fortfarande kommer att vara exkluderade från patenterbarhet. Det verkar som om man håller svensk patentlag vid EPC52, som explicit exkluderar datorprogram (“as such”).

Motionstiden för att svara går ut den 11 april.

   Jag var för ett par år sedan på en presentation av PRV där man bland annat kom in på just det här med harmonisering. Jag hoppade då in och frågade varför harmonisering alltid betyder utökning av IP-rättens omfattning. Det är inte som i andra sammanhang då harmonisering kan betyda att man kompromissar eller att det kan slå åt båda hållen. Nej, när det gäller IP-lagarna är harmonisering bara en förskönande omskrivning för en konstant utökningen av vad de täcker.

   Som väntat fick jag inget bra svar från PRV-representanten.

   Det är en vinnande strategi från IP-förespråkarnas sida. Få igenom en utökning på ett håll, sedan kan man betydligt enklare dra med övriga länder i harmoniseringens namn.
