Nu börjar Monique Wadsted, som representerar amerikanska filmbolag, med sina skadeståndsanspråk.

“Att ta bort en torrentfil är inte svårare än det är för oss vanliga datoranvändare att ta bort en Wordfil – de har helt enkelt valt att låta bli.” Hon förklarar åtminstone lättfattligt för rätten. Sedan kan man ju fråga sig varför de skulle ta bort torrentfiler. Det blir rättens sak att avgöra.

“Varje användare som har laddat ner ett fullständigt exemplar gör sig alltså skyldig till både exemplarframställning och tillgängliggörande för allmänheten.” Wadsted konstaterar att någon som tankat hem en fil över BitTorrent börjar seeda.

Det är intressant att notera att den inställningen skiljer sig från Danowskys/skivindustrins inställning; de hävdade tidigare idag att en person, som redan börjar dela ut delar av ett i sig ofullständigt verk över BitTorrent (alltså inte har hela verket hemma ännu), gör sig skyldig till tillgängliggörande.

Wadsted fortsätter, och pratar om datum för när Harry Potter and the Goblet of Fire hade premiär på bio i USA och i Sverige och The Pirate Bay, och andra filmer, och vidare statistik. Prison Break.

    Sedan kan man ju fråga sig varför de skulle ta bort torrentfiler.

    Just det. Alla skall betraktas som oskyldiga tills motsatsen är bevisad och sådant sysslar domstolar med, inte TPB!

    Rick tell us, did she also mentioned that it was antip2p2 themself that uploaded well over 6 times the full series bandwith of prison break?

    If the court is to believe their screenshots as evidence, then it shows that antip2p uploaded well over 26 gigabytes of prisonbreak season 1 content to get themself the roughtly 4 and a half gigabytes that the series consisted off.

    Given that antip2p themself uploaded so much and was so helpful to the swarm :-) isn’t it reasonable to interfere that this (and all the other ones where they uploaded more then one time the whole contentbandwith was a legal download offering from the rightsholders?

    I mean If i had downloaded the series back then (which I haven’t) It would have been possible that I have gotten the whole series very well just for over 99% of the content just from that one extra good seeding swedish apb peer given how slow normal users lines in other parts of the world are!

    Här bluffar denna dam, hon borde ju veta bättre.

    Alla som hållit på med fildelningsteknik vet väl att ifall Distributed hash tables (DHTs) är aktiverat, så fungerar fildelningen utan någon tracker. Och alltid är det någon vänlig själ som lägger upp den “raderade” torrenten någon annanstans på Internet, eller lägger upp en ny torrent.
